古騰堡計畫的著作權

頃接獲根據古騰堡計畫基金會執行長(CEO of the Project Gutenberg Literary Archive Foundation, PGLAF)克雷格‧紐比(Greg Newby)博士的回信，大意如下:

毛教授您好，

謝謝您指導學生在 copy.pglaf.org 網頁提出著作權申請。

很多申請並不符合美國公版著作的要求，常見的情況有:

1. 當代作品必須是 1923 年以前出版，才符美國公版著作的要求。

2. 出版年不詳的舊作品，若提供近代的重印本，必須完全等同於 1923 年以前的出版品，才被視為公版著作；學生多半未提供舊著的出版資訊，所以，我無法以規則一認證它們的公版性。

在 http://copy.pglaf.org/ 裡，要求每個申請認證者，必須提出
書名頁及版權頁的影像檔，以及其他包括出版年等相關資訊的頁面，這些頁面必須含有: 著作、書名、出版年、出版地等資訊，當然，還包括版權聲明，如 "版權所有 翻印必究" 等字樣。

未取得認證碼者，請重新再提出認證申請

- 原始出版年，必須符合公版著作的規定(美國規定為 1923 年以前的出版品)
- 增加的注解、評論等，也需符合公版著作的規定
- 重印本必須沒有新的資料，才能符合公版著作的規定
- 作者往生於 1912 之前
- 呈交書名頁及版權頁的書影
- 書名及著者譯為英文，或漢語拚音

Dear Prof. Mao: Thanks very much for the submissions from your students to the copyright clearance site at copy.pglaf.org However, many were not public domain in the US. Here are the most common problems: 1. Contemporary works. Only titles published prior to 1923 are in the public domain in the US. 2. Prior publication date unclear. If a recently published book is provided, but is entirely identical (a reprint) to a pre-1923 book, it is public domain. But the students often do not include the prior publication information, so we cannot clear them under rule 1. Thanks for guiding your students! -- Greg Newby
